General Terms and Conditions
These “General Terms and Conditions” regulate the use of the accommodations and services of the Provider.
According to the General Terms and Conditions, the operator, the service provider, Vizitündér Vendéglátó és Szolgáltató Kft. (registered office: 2724 Újlengyel, Nr. 74. Kossuth Lajos Str; Tax number: 14587722-2-13), hereinafter referred to as the Service Provider, concludes an Accommodation Contract with the persons, Contracting Parties, using the accommodation service.

Contracting parties
- Purchaser/Customer: A person who makes use of the services of the Lodge and purchases the services in writing through the reservation system, the website of the Lodge, or the e-mail address of the Provider vizitunderapartman@gmail.com, and who acknowledges and accepts the General Terms and Conditions as binding, hereinafter referred to as the Guest.

Purpose of the General Terms and Conditions
The General Terms and Conditions (GTC) determine the general terms and conditions of the legal relationship between the Service Provider and the Guest, who enters into a contractual relationship with the Service Provider. The provisions of the Hungarian laws and regulations in force, as well as the provisions of the Civil Code, shall apply to the activities of the Provider of Services in all matters not regulated herein, without any special provision to the contrary.
Acceptance of the General Terms and Conditions
Acceptance of the Terms and Conditions by the Guest is a prerequisite for the purchase or use of the Service. Acceptance of the Terms and Conditions shall be deemed to have been made when the Guest uses the Service provided by the Service Provider.
Scope of the Terms and Conditions
The Service Provider reserves the right to modify these Terms and Conditions, in whole or in part, at any time. The TOS shall remain in force as long as the Service Provider provides the Service. These T&Cs shall be in force from 26 April 2023 for an indefinite period.
Territorial scope of the Service
The Service provided by the Service Provider is available from both domestic and international locations.
Contractual terms
Guest: a person who uses the services of the accommodation and purchases the services through the reservation systems, the website and e-mail, and who acknowledges and accepts these GTC as binding upon him/herself, hereinafter referred to as the Guest.
Service Provider: by the provisions of these GTC, Vízitündér Recreation Park, Vízitündér Vendéglátó és Szolgáltató Kft., Klemencz József, hereinafter referred to as the Service Provider
Service: accommodation service
Price Offer: The written price offer of the Provider of the Service in response to the written offer request of the Guest.
Reservation: Reservation: the written confirmation of the Guest’s written reservation sent by the Service Provider, which includes the subject, location, duration and price of the Service, as well as the information required to finalize the reservation, including the payment of 40% of the total accommodation cost.
Confirmation of the Reservation: Payment of the 40% specified in the Reservation to secure the Reservation, which must be paid within 24 hours. The reservation is validated after the payment of the 40% and is therefore considered a written contract and implies the automatic acceptance of the General Terms and Conditions and the Booking, Payment and Cancellation Conditions.
Booking, Payment and Cancellation Conditions: The conditions for the payment of the service provided by the Water Fairy Theme Park, the booking and payment methods, the timetable, the cancellation of the booking and the non-refundable amount in the event of cancellation. Territorial scope of the service: The service provided by the supplier is available from both national and international destinations.
The Service Provider provides the Service under the following conditions
- Maximum number of people: 12.
- The Provider shall be responsible for the accommodation of the Guests.
- We will do our utmost to ensure the safety of our Guests and to advise them of any possible hazards, but we cannot accept any liability for their personal property in the house or the free parking area, or for any personal injury or damage to the house or its surroundings resulting from improper use. The Guest shall be liable for any damage caused by the Guest to the house, its contents and surroundings.
- In the event of a problem, we can be contacted at the telephone number or email address given in these terms and conditions to assist you during your stay, but we cannot accept any complaints after you have left.
Procedure for requesting a quotation or making a reservation
- The Supplier shall send an offer in response to the written request for an offer sent by the Guest. The offer may be modified by mutual written agreement. If the Guest does not respond to the offer, the offer shall be cancelled after 3 days.
- The booking shall be deemed to have been made when the Service Provider has confirmed the Guest’s booking in writing via the booking system, the website after the Guest has paid 40% of the total cost of the accommodation, and shall therefore constitute a written contract and the acceptance of the Booking, Payment and Cancellation Terms and Conditions and the General Terms and Conditions. The Guest agrees that the Service Provider will not refund the amount paid in advance for the reservation cancelled by the Guest at the time of validation of the reservation.
- Any reservation, agreement, modification or verbal confirmation of the same by the Service Provider shall have no contractual value.
- The content of the Contract shall include the subject matter, location, duration, and price of the Service, as well as the booking, payment and cancellation conditions and the applicable Terms and Conditions.
- Any changes or additions to the contract must be agreed in writing by the parties. Once a booking has been made and confirmed, it may be changed to a different date or number of people, subject to availability and as detailed in the Cancellation Policy.
- The service provider is free to change the advertised prices without prior notice unless the prices are fixed for a certain period.
- The local tourist tax in Újhartyán is HUF 0 per guest per night, payable in addition to the accommodation price. The tourist tax must be paid by persons between 18 and 70 years of age.
- The operator of the guest house is not responsible or liable for any accidents or damages that may occur during the use of the services (active recreation) advertised on the website and elsewhere. The advertised services are used at the guest’s own risk.
- There is no possibility of reimbursement for the services booked but not used or changed during the stay of the Guest (accommodation, mediated services).
- The contract for the use of accommodation services is limited in time.
- If the Guest permanently leaves the Accommodation before the end of the fixed period, the Provider shall be entitled to the full price of the services provided under the Contract. The Supplier shall have the right to resell the Cottage if it becomes vacant before the end of the period.
- Any extension of the accommodation service at the request of the Guest shall require the prior consent of the Provider. In this case, the Supplier may demand reimbursement for the service already provided.
Modification or cancellation of the service
- Offer: The offer may be modified by mutual written agreement. If there is no response to the offer, the offer will be cancelled after a 3-day grace period.
- If the 40% deposit required by the supplier to confirm the reservation is not paid within the agreed time, the reservation will be cancelled. Any reservation, agreement, amendment or verbal confirmation of the reservation, agreement or amendment by the Supplier shall have no contractual value.
- Once a reservation has been made and confirmed, it may be changed to another date or the number of people may be changed, subject to available capacity and by the Booking, Payment and Cancellation Conditions.
- The Service Provider Guest House is free to change its advertised prices without prior notice, except where it is not committed to a specific period.
Conditions of use
- The Guest may use the accommodation by checking in on the day of use from 14:00 to 23:00 and checking out by 10:00 on the last day of the stay.
- On arrival at the accommodation, the Guest must provide proof of identity by the legislation in force before checking in. By filling in and signing the check-in form, the Guest accepts and complies with the general terms and conditions of the accommodation establishment and the posted policies of the accommodation establishment.
- The accommodation establishment is not responsible for any damage caused by the Guest. The cost of the damage will be charged to the Guest.
- For reasons of hygiene and given the increasing number of allergies, pets are not allowed in the accommodation. The Guest will be held liable for any damage caused by pets brought in without permission.
- Smoking is not permitted in the apartments.
Refusal to use the Accommodation, Termination of the Contract
The accommodation shall be entitled to terminate the contract and refuse to provide the service if the Guest
- is in default of payment.
- does not use the accommodation for its intended purpose
- suffers from a contagious disease
- is under the influence of drugs
- engages in unacceptable, immoral, violent or incompatible behaviour in the accommodation and its surroundings.
- in the event of causes beyond the control of the parties, so-called Vis Major (war, fire, flood, adverse weather conditions, power cuts, strikes), over which the party has no control.
Rights of the Guest
- The Guest shall have the right to use the Accommodation for its intended purpose,
- The Guest has the right to use the equipment and facilities of the Accommodation.
- In the event of any problem arising during the stay, the Guest may contact the local representative of the Service Provider or the Accommodation Provider by telephone (+36 30 950 3844) or in writing at vizitunderapartman@gmail.comtoo resolve the problem as soon as possible.
- The Guest’s right to complain shall expire upon leaving the accommodation.
Obligations of the guest
- The Guest is obliged to pay for the services by the date and in the manner specified in the Contract.
- The Guest may not deviate from the chosen method of payment without the prior consent of the Provider. If the Guest is unable to pay for the ordered service, the ordered service will be deleted from the system.
- The Guest shall ensure that children under the age of 18 who are under his/her supervision are present in the Accommodation only under the supervision of an adult.
- The Guest is obliged to compensate the Provider for any damage caused by him/her, his/her companions or persons under his/her supervision.
- The Provider shall not be liable in any way for any incorrect information provided by the Guest and for any damage resulting from such incorrect information.
Rights of the Provider
- The Provider shall be entitled to retain 40% of the amount received for the Accommodation Services ordered and confirmed by the Guest, but not used by the Guest, by these General Terms and Conditions and the Booking, Payment and Cancellation Conditions.
- The Provider has the right to refuse or cancel the accommodation service in case of the provisions of clause 10.
Liability of the Provider
- The Provider of Service shall be obliged to investigate the complaint of the Guest during the stay and to take the necessary steps to solve the problem.
- The Service Provider shall provide the Guest with its telephone contact details to resolve any problems or issues that may arise during the Guest’s stay.
- The Service Provider shall not be liable for any electrical equipment brought in by the Guest, and the Guest shall be responsible for any damage caused by such equipment.
- The Service Provider shall not be liable for any damage caused by the Guest or for any damage caused by circumstances beyond the control of the Guest.
- The Service Provider shall not be liable for any personal belongings, valuables or cash left in the public areas or rooms of the Service Provider.
- The Service Provider shall not be liable for any damage caused by an act of nature, force majeure or any other cause or event beyond the Service Provider’s control and for which the Service Provider cannot be held responsible.
- The Service Provider reserves the right to change prices.
- The Service Provider shall store the Customer’s details to perform the contract and for subsequent proof of the terms of the contract, but shall not be entitled to pass them on for advertising or any other purpose without the Customer’s express consent.
Booking, reservation, payment and cancellation conditions
- The reservation is valid upon acceptance of the Booking, Payment and Cancellation Conditions and the General Terms and Conditions after 40% of the total accommodation price has been paid in advance and confirmed. If the requested amount is not received by the stated deadline, the Provider’s obligation to offer and provide the service shall also cease.
- The 40% payment can be made by bank transfer. The balance must be paid on-site before occupying the accommodation or by bank transfer before arrival. The Service Provider shall publish its payment and cancellation terms in a separate statement on its website.
- All costs associated with the use of any payment method shall be borne by the Contracted Guest.
Privacy Policy
- The Service Provider attaches great importance to the protection of personal data and takes all security, technical and organisational measures to guarantee the security of the data, storing the Guest’s data only until the day of check-out.
- In fulfilling its obligations under the Contract, the Service Provider shall comply with the legislation in force on the protection of personal data and the disclosure of data of public interest.
- The Guest acknowledges that the Service Provider is required by law to provide the requesting authority with the data required by law.
- The Service Provider shall publish its privacy policy in a separate privacy statement on its website.
